The draft Law is expected to be ratified later this year as Viet Nam moves closer to what deputies hope will be World Trade Organisation (WTO) accession. The new legislation marks a giant step in Viet Nam’s economic adaptation to WTO legal rules, with the Government vowing to push hard for the law’s ratification and protection of IP rights. "Viet Nam is clearly facing a number of challenges in its accession to the WTO, one of which is to ensure full protection and implementation of IP regulations," said Bui Manh Hai, Deputy Minister of Science and Technology. "Legal issues on IP will be addressed in only one legal document – the Law on Intellectual Property." The draft law has 14 … [Read more...] about NA reviews draft on intellectual property

NA mulls draft laws on electronic transactions, intellectual property

October 6, 2005 by vietnamnews.vn

NA mulls draft laws on electronic transactions, intellectual property (06-10-2005) HA NOI — The process of presenting signatures electronically sparked a debate among members of the National Assembly Standing Committee yesterday on whether to write detailed regulations into the draft Law on Electronic Transactions. Skeptical deputies pointed to the fact that, because regulations on the order and method of presenting signatures electronically would depend on businesses’ technological capability, it could not be covered in detail in the law. The law’s drafting committee told the National Assembly committee yesterday that regulations on electronic signatures were based on common and existing technological principles which were standard operating procedures for any business that would seek to conduct electronic transactions. Electronic signatures would be validated by the user and were considered safe when supported by a qualified service provider, the committee said. … [Read more...] about NA mulls draft laws on electronic transactions, intellectual property

Geographic indicators offer alternative to trademark protection

August 25, 2009 by vietnamnews.vn

Talking Law (26-08-2009) Building brand identity with geographical indicators "Proudly Made in Viet Nam" is not a catch phrase one sees blazoned across many products. For a long time consumers have associated imported products with quality, turning away from domestically manufactured goods. But the mood has begun to change, with the Government urging Vietnamese businesses to build their brand identities. Viet Nam News reported on August 19 that officials had told a conference in HCM City that domestic dairy products were "as good as imports". But it is not only the domestic market that should be targeted. As Viet Nam asserts itself as a credible international player, it must market itself aggressively, and internationally recognisable "brands" is one way this can be achieved. Raising the profile of Vietnamese farmers is particularly vital. In the past, through a lack of awareness and an overriding need to sell their crop, farmers have allowed their produce to be … [Read more...] about Geographic indicators offer alternative to trademark protection

A laboratory at HCM City International University under Việt Nam National University-HCM. — VNA/VNS Photo Gia Lộc Viet Nam News Gia Lộc HCM CITY — Enterprises have been reluctant to cooperate with universities on commercialisation of their inventions and products because of the lack of intellectual property (IP) protection, according to the Việt Nam Invention Association. Commercialisation of applied research could bring huge profits for universities, according to the association. Phan Thị Châu, the association’s vice president, said: “If a research solution is applied and truly useful, it would have huge value. It is a waste not to commercialise it.” However, for enterprises to make a product, the applied research product or invention needs to have a registered copyright. “If there is no copyright, it is difficult for enterprises to invest a large amount of money in commercialisation,” Châu said. To date, only few universities have paid attention … [Read more...] about Universities urged to seek IP protection for applied research products

Illustrative Image phapluatplus.vn By Thu Trang HÀ NỘI — Nguyễn Bích Ngọc, a junior high school student in Hà Nội, started to use a smartphone when she was a 6th grader. Seeing most of her classmates use Facebook, Ngọc (not her real name, to protect her privacy) managed to set up an account for herself. Facebook regulates that people can set up an account only when they are over 13 years old, but Ngọc simply lied and said she was older than she was, because “no one inspected it”, she said. Being free to make friends with everybody around the world, Ngọc was happy when her friend list reached thousands of people. “I did not know most of the people on my friend list in real life,” she said. Ngọc has shared a lot of her information on her Facebook, although she does not know the identities of her friends, nor where they are. “For a time, I used to neglect my studying because I spent so much time taking photographs, posting them up, counting likes and answering … [Read more...] about Joining hands to protect children on the internet
