NA deputies pass three pressing laws (22-06-2006) HA NOI — The National Assembly (NA) yesterday passed three laws: the Real Estate Business Law, the Cinema Law, and the HIV/AIDS Prevention and Control Law. The Law on Real Estate Business, which was approved with 79.72 per cent of deputies’ vote, regulates real estate business activities and the rights and obligations of institutions and individuals who engage in real estate business and transactions. The draft law had earlier been published in the mass media for voters’ response before the legislators decided its fate. During the final debating sessions on the law, most deputies agreed with the legislation’s content and heard a report on the public response to the draft law presented by Nguyen Duc Kien, Chairman of the NA Economic and Budget Committee. Legislators revise, pass clutch of laws (21-05-2005) HA NOI — New and revised laws governing national defence, commerce, State auditing, and education were passed by the National Assembly yesterday. The revised Commerce Law of nine chapters and 324 articles passed with 75.5 per cent approval. The law, which comes into effect on January 1, includes an article allowing the establishment of commercial associations to protect the rights and legitimate interests of traders. It also requires almost all commercial activity to accord with international practice. It does not include unregistered small merchants and street vendors, despite the opinion of many legislators that it should do so. Instead, it assigns the Government to set specific regulations for these traders. Major projects A draft resolution on criteria for key national projects was passed by NA delegates yesterday on the thirty-first working day of the ninth session.The resolution was approved by 84.99 per cent and it will come into effect on October 1. Under the resolution, key national projects must comply with the following criteria: The amount of invested capital should be at least VND20 trillion (US$1.25 billion), with 30 per cent or more coming from State coffers. Projects posing a serious potential risk to the environment, such as nuclear power plants and projects changing the land use of protected forests and natural reserves are also included. NA passes new laws on trade, tourism, minerals (13-06-2005) HA NOI — The National Assembly has passed two new laws on tourism and trade tariffs besides amendments to an existing law on minerals. On Saturday, the house approved the Law on Tourism and Law on Import and Export Tariffs, which will both take effect at the start of the new year, and amendments to the Minerals Law of 1996 which decentralise licensing powers. Comprising seven chapters and 29 articles, the Law on Import and Export Tariffs includes articles on tax payers, tax on cross-border exchange of goods, tax calculation, and protective measures against dumping. It codifies existing regulations on tariffs and fulfils Viet Nam’s commitments towards integrating into the global economy, particularly its efforts at WTO membership.
