People’s Council ordinance amended (02-04-2005) HA NOI — National Assembly’s Standing Committee approved 13 new amendments on the functioning of the country’s people’s councils yesterday at its 27th session. All 13 amendments received the majority vote of members, according to Bui Ngoc Thanh, chief of the drafting board. The amendments covered issues, including live media broadcasts of people’s council meetings, relationship between NA delegations and standing members of people’s councils at provincial level and allowances for people’s council members. The amendments to Article 9 allows local media and press agencies to attend public meetings of people’s councils, opening and closing ceremonies, debate sessions and to broadcast them live. Anti-dumping decree to guide ordinance (16-07-2005) HA NOI — To guide implementation of the new anti-dumping ordinance, the Government has issued a decree under which an investigative and arbitration agency will be set up. Under Decree 89, in an anti-dumping case, the investigating body will seek suggestions for anti-dumping measures and ask concerned parties to furnish documents and information. The investigators, after consultations with the concerned parties, will make a preliminary conclusion and possibly suggest a ruling of a temporary import tariff. The council will consider the conclusions and give the final verdict whether an import is subsidised or threatens domestic production. It will then ask the trade ministry to slap a permanent anti-dumping tax on specific imports. But the decree also empowers the ministry to withdraw the ruling if the application of an anti-dumping tax threatens to harm the economy. The ordinance and resolution were passed by the National Assembly’s Standing Committee in April 2006. Briefing the press, Deputy Judge of the Supreme People’s Court Dang Quang Phuong said the revised and amended ordinance was in accordance with the revised and amended Law on Petitions and Denunciations. Ha Noi — The highlight of the meeting of the National Assembly Standing Committee yesterday was the proposed changes to the existing Ordinance on Judges and Jurors of the People's Courts regarding the scale of ranking judges and court levels. Truong Hoa Binh, Chief Judge of the Supreme People's Court, said that under the current ordinance it was very difficult for the court sector to implement the Party and Government's policies and guidelines on transferring judiciary staff from the People's Courts at higher levels to lower levels. He said that the existing salary system applied to judges depended on their scale of ranking and the levels of their administrative courts and was the main barrier for transferring judges from one office to another. He cited as an example that the allowance of a Chief Judge at the Provincial People's Court was 0.65 per cent of the minimum salary, while a Chief Judge at the District People's Court was 0.55 per cent.
